1. About AigenFlow
These Terms of Service (“Terms”) govern your use of services provided by AigenFlow (“we”, “us”, “our”).
By subscribing to or using our services, you agree to these Terms.
Our services include deploying, configuring, and hosting AI chat agents for websites and messaging channels (the “Services”).
2. Eligibility
You must be at least 18 years old and have legal authority to enter into contracts on behalf of yourself or your business.
3. Your account
You are responsible for:
Providing accurate account information
Keeping login details secure
All activity that occurs under your account
Notify us immediately if you suspect any unauthorized access.
4. Services we provide
We will:
Set up and configure AI agents and related integrations (e.g., chat widget, WhatsApp, calendar, CRM)
Host the agent and provide ongoing maintenance and tuning
Provide support within the response times of your plan (SLA)
We may update or improve the Services over time.
5. Your responsibilities
You agree to:
Use the Services only for lawful purposes
Not submit illegal, harmful, or infringing content
Ensure you have a lawful basis for any personal data you send to the AI agent
Comply with applicable laws, including data protection and consumer laws in your country
You remain the data controller for any personal data that your end users provide to the AI agent.
6. Plans, fees & payments
We currently offer subscription plans such as Basic, Pro, and Enterprise with monthly fees, plus a one-time setup fee.

Fees are billed in advance, typically monthly.
Payments are processed securely by Stripe (or other specified provider).
Subscriptions renew automatically until cancelled.
If payment fails after repeated attempts, we may automatically pause or terminate access to the Services.
7. Cancellations & refunds
You can cancel your subscription at any time via your account or by contacting us at support@aigenflow.net.
Cancellation stops future renewals; you remain responsible for any charges already incurred.
Unless required by law, fees already paid are non-refundable, except where we explicitly agree otherwise.
Upon cancellation or termination, your AI agent will be paused and may be deleted after a retention period.
8. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability.
We may temporarily suspend the Services for maintenance, security reasons, or events beyond our control.
9. Intellectual property
We retain all rights in:
Our software, platform, models, and underlying technology
Our brand name, logo, and content
You retain all rights to your own data, prompts, and content.
You grant us a limited license to process that data solely to provide the Services.
10. Confidentiality
Both parties agree to keep each other’s non-public information confidential and use it only for the purpose of delivering the Services, unless disclosure is required by law.
11. Data protection
Each party will comply with applicable data protection laws.
When we process personal data on your behalf as a processor, the Data Processing Addendum (DPA) between you and AigenFlow will apply.
12. Limitation of liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages (including loss of profits or data).
Our total liability for any claim relating to the Services is limited to the amount you paid us in the last 3 months.
Nothing in these Terms excludes liability for fraud, intentional misconduct, or where otherwise prohibited by law.
13. Termination
We may suspend or terminate your access to the Services if:
You materially breach these Terms and do not fix the breach after reasonable notice, or
You fail to pay fees when due.
Upon termination, your access to the Services ends and we may delete related data after any applicable retention period.
14. Governing law
These Terms are governed by the laws of Cyprus, without regard to conflict of laws rules.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus, unless mandatory law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time.
If changes are material, we will notify you by email or via the Service.
Continued use after changes take effect means you accept the updated Terms.
